Welcome to ZOFTREK LLC. By downloading, installing, or using any of our applications, you agree to the following terms and conditions. These Terms of Service apply to all ZOFTREK LLC mobile applications available on the Apple App Store and Google Play.
By using our applications, you confirm that you are at least 13 years old and agree to provide accurate and complete information when required. ZOFTREK LLC reserves the right to refuse or terminate access to any user at any time, as further described in Section 7.
All content, features, and functionality of our applications — including the source code, designs, graphics, trademarks, brand names, logos, and any associated documentation — are owned by ZOFTREK LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our applications for your personal, non-commercial use on devices you own or control. If you believe your copyrighted work has been infringed, please contact us at contact@zoftrek.com.
Your use of our applications is also governed by our Privacy Policy and Privacy and Data Policy, which are incorporated into these Terms by reference.
"Content" refers to all information, data, text, photographs, videos, audio clips, software, scripts, graphics, and interactive features generated or made accessible through our applications. Users are solely responsible for any content they provide. You may not commercially exploit any content without prior written permission from ZOFTREK LLC.
Some of our applications offer premium features through auto-renewable subscriptions or one-time in-app purchases. All purchases are processed by Apple (App Store) on iOS or Google (Google Play) on Android. ZOFTREK LLC does not store payment card information.
Auto-renewable subscriptions automatically renew at the price displayed at purchase, unless cancelled at least 24 hours before the end of the current billing period. The renewal charge is applied to your Apple ID or Google account at the start of each new period.
Refunds for App Store and Google Play purchases are handled by Apple and Google directly and are subject to their respective policies. Refund requests may be submitted at reportaproblem.apple.com (Apple) or play.google.com/store/account/subscriptions (Google). See our Support page for additional guidance.

You may stop using our applications at any time by uninstalling them. We may suspend or terminate your access to any application if you violate these Terms of Service, the App Store or Google Play platform terms, or applicable law. Sections of these Terms that by their nature should survive termination — including Sections 2 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), and 10 (Governing Law and Venue) — will continue to apply after termination.
Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ZOFTREK LLC does not warrant that the applications will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.
To the fullest extent permitted by law, ZOFTREK LLC and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or related to your use of our applications, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, ZOFTREK LLC's aggregate liability for any claim arising out of or related to these Terms or our applications shall not exceed the greater of (a) the amount you paid to us through Apple or Google for the application in question during the twelve (12) months preceding the event giving rise to the claim, or (b) US$10. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the smallest extent permitted by law.
These Terms of Service and any dispute arising out of or related to them or your use of our applications shall be governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws provisions. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to the personal jurisdiction and venue of such courts. Nothing in this section limits any non-waivable rights you may have under the consumer protection laws of your jurisdiction.
ZOFTREK LLC shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, acts of war, equipment failures, or internet outages.
ZOFTREK LLC reserves the right to modify these Terms of Service at any time. The "Last Updated" date at the top of this page indicates when the most recent changes were made. Changes will be effective immediately upon posting. Your continued use of our applications after changes are posted constitutes your acceptance of the updated Terms.
